An Update on the parole hearing of Cop-killer Anthony Wayne McIntosh

Dear Family, Friends and Concerned Citizens:

First, we must apologize for the long delay in advising you about the outcome of the parole hearing for Anthony Wayne McIntosh, the man who killed our son, Ptlm. Jeffrey M. Phegley, Morrow, Police Officer, in 1987. The reason for the delay in contacting you is that the parole hearing was not held, and we have been informed that the parole hearing has, for now, been postponed indefinitely. Below is background information regarding this case.

After getting all of our protest letters and petitions ready to present to the Parole Board, we waited for our review date. Shortly after Christmas, we got a letter informing us that McIntosh would be coming up before the Parole Board in January 2006 and we should schedule an appointment to present our letters and petitions protesting his parole. However, before we could arrange our appointment, we got a phone call from the Parole Board representative assigned to the case, telling us that McIntosh’s hearing had been postponed indefinitely. We asked for an explanation as to why this had happened and this is what we were told.

The Ankrom Decision recently approved by Ohio Courts, which gave McIntosh and 2,500 other Ohio inmates the change for early OR moved up parole hearings, has been called back into the Ohio Courts for another review. There has been controversy surrounding the Ankrom Decision and about the needs additional review and consideration. This pending decision could affect McIntosh’s consideration for an early parole hearing. For now, while the Ankrom Decision is under review, his next parole hearing has been pushed back to his original eligibility date of 2010.

So, that is where we are. We have waited as long as we feel we possibly can to inform you of what is happening. Everyone has been so helpful and worked so very hard on our behalf and we thank you so much for all you have done. Some good news is that all the protest letters and petitions we have collected will be considered when McIntosh does finally come before the Parole Board. So your effort and hard work was not in vain.

Of course, it is our hope that McIntosh will never be paroled. After all, our son, Jeff, does not get a parole from his grave. So for us he should NEVER get out.

We thank you for your patience and understanding. Again, we apologize for not informing you sooner about this parole hearing status. We had hoped to know something more about what is happening in the Ohio Courts regarding the action on the Ankrom Decision so we could share that information with you at this time, but to our knowledge it is still undergoing review.

We sincerely thank each and every one of you who so generously gave your time and effort to help us. We are grateful for all you have done on our behalf, and on behalf of our dear son, Jeffrey.
